So I still have no idea if Hazel's picture is valid or not. Here's the email I got which basically just quotes back the very rule I was for clarification on....... Dear Blanche Axton, Thank you for contacting us regarding the Bissell MVP 2011 Photo Contest. Your question is very important to us. As stated in the programs Official Rules, "the Submission cannot have been submitted previously in a promotion of any kind or exhibited or displayed publicly through any means." Should you need any additional clarification, or have any other questions regarding this promotion, please do not hesitate to contact us directly. Thanks, Bissell Customer Service On Thu Jan 13 20:27:58 2011, blanche.axton@gmail.com wrote: > from: blanche.axton@gmail.com> > Name: Blanche Axton > > Issue Type: Eligibility > > Deploy Path: bissell/mvpcontest > > Browser Version: Firefox 3.5 (Gecko 1.9.1. on WinVista > > Flash Installed: 10.0.32 > > Locale: en_US > > message: > > I have posted this picture on a website that Pugalug Pug Rescue runs > to promote our rescue. There is a chat forum where I have posted the > picture. Is that considered an ineligible photo?

By the sounds of it Blanche, I hate to say, that it seems that any picture seen by the public can not be displayed. WTF??
Ok, So i guess I have to get a recent picture of Odie that is priceless, that no one has ever seen, hmmm this could take a while.

Gee,that was a very helpful response... I think if it is taken literally then only a photo that has never been seen anywhere else can be used. Though in a court, there are different definitions of what is considered public, especially with the internet.

I'm going to try and call them tomorrow and get some clarity on this. I think it's unreasonable to expect a rescue or owners of rescued animals not to have displayed their pet pictures on any public forum. And I don't keep track of what has and hasn't been posted.
Does Tanya's website count as public? All the photos she took of my crew are on her website so does that mean they don't qualify (assuming I had her permission)?

well I would think Tanya's site is public as it is her biz??? It definitley needs clarification I would agree if you had already used the photo in another promotion; then it isn't fair to use again BUT since this is the information hwy these days how do you not stop a photo being anywhere/everywhere?!?!?!?

Hope you actually get clarification and it's not all in vain. If the photo is the issue, perhaps take a brand new one that's never been anywhere before and post it directly to the contest.
Just curious if anyone from Pugalug applied for the Buildabear grant yet, it includes Canada and is up to $10,000? The program is still available and the information was posted in the Fundraising section on the Pugalug forum, with all the links.

Now, unless you posted it somewhere else, it may be safe. Only members of the forum can see the picture. It is not public, unless you are a registered forum users. Guests can not se pictures.

Well that will depend on whether the picture was on the site before or after being part of the contest. If it was before then yes, it would likely be disqualified but if it was only after Bissell had publicly displayed it and they put it on the site with a link to Bissell it is different. Amanda do you know if it was on the cat site before the Bissell contest with no association to Bissell?

Okay--well, any of my pictures have only been on the Pugalug forum or the Pug Authority forum so I'm not going to worry about it.
I tried calling, got put on hold for 45 minutes before I gave up. I'm going to "let sleeping dogs lie", as it were.

I would leave it too, Blanche! if they are going to be that anal To actually track down a picture and Whether it was or wasn't on the world wide Web would take exponential amts of time and Money to do so!! I don't think that will ever happen! L

They have to know that there will be many rescue groups entering this contest and many will use pictures that were on that type of site.
