MAXWELL HOUSE BREW SOME GOOD CONTEST
1. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. Beginning at 12:01 a.m. Eastern Daylight Time ("EDT") on March 26, 2008, through 11:59 p.m. EDT on March 30, 2009 ("Contest Period"), log on to
www.brewsomegood.ca and click on the Brew Some Good contest icon and follow the on-screen instructions to enter. March 30, 2009, shall be the "Contest Closing Date". Each entry must include the following: 1. An essay (in 100 words or less) nominating an individual, community or organization ("Nominee") you think does good for the benefit of others and should receive a cash prize to continue in their efforts; 2. Nominator information: Name, email address, street address, city, province, postal code, age and phone number; and 3. Nominee information: Name of person and/or organization being nominated, email address and/or website address (if applicable); street address, city, province, postal code, age and phone number. The Nominator's essay should explain in his/her own words, why he/she feels the Nominee has made a difference by helping another person or group of people. You may not nominate yourself . You may nominate a community or organization that you are affiliated with. You may nominate as many different people or organizations as you wish, however you may only nominate the same individual or organization one time. Limit one entry per nominator per day. Entries generated by script, macro or other automated means will be void. Released Parties (as defined below) are not responsible for late, lost, illegible, incomplete, stolen, or misdirected entries. All requests become the property of the Sponsor (as defined in this agreement) and will not be returned.
2. ELIGIBILITY: Contest is open to legal residents of Canada, who are 18 years or older or of legal age of majority in their province of residence as of March 26, 2008. Employees of Kraft Canada Inc. ("Sponsor"), Promotions.com LLC, ("Judges") and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, (collectively, "Promotion Parties"), any independent judges as assigned by the Promotion Parties and/or those living in the same households of each are not eligible to enter or win. Potential prize winners will be required to execute and return a Declaration and Release within seven (7) days of date of attempted delivery or prize will be forfeited and awarded to an alternate winner. In order to receive a prize, the Nominee must provide documentation of the services performed as listed in the Nominator's essay. The return of any prize/prize notification as undeliverable or noncompliance with the terms of these Official Rules may result in disqualification and selection of an alternate winner.
Potential winners must correctly answer, unaided and within a set timeframe, a mathematical skill-testing question administered by telephone. In the event that the potential winner incorrectly answers the skill testing question, or declines the prize another potential winner will be selected.
No correspondence will be entered into except with the potential winners.
3. JUDGING CRITERIA: Eligible entries will be judged by a Sponsor designated panel under the supervision of Judges. Judging will be based on the following criteria: Impact Nominee has on others (how much good Nominee does) – 50%; and Impact donation will have for Nominee (additional "good" nominee can do with the benefit of winning the prize) – 50%. Entries must not have won a previous prize or award nor have been previously published and must be entrant's original work. In the event of a tie, tied entries will be re–judged on the basis of Impact Nominee has on others – 100%. Potential winners will be notified by phone and e–mail within two weeks following each bi–monthly judging period. Non–winning entries not selected in any bi–monthly judging period will automatically qualify for all subsequent judging periods.
4. PRIZES/APPROXIMATE RETAIL VALUES (ARVs): At the beginning of the contest, seventeen (17) Grand Prizes are available to be won, each consisting of a cheque in the amount of $10,000 CDN payable directly to the winning Nominee (person or organization listed on Nominator's entry). Two winners will be determined bi–monthly beginning at the end of May 2008 with an additional five winners determined at the close of the Contest for a total of seventeen (17) prizes. Total ARV of all prizes: $170,000. Limit one (1) prize per email address, person, or organization. No substitutions or transfers of prizes by winners permitted. Sponsor reserves the right to substitute prizes of equal or greater value, at its sole discretion.
5. GENERAL RULES: Void where prohibited. By entering contest, entrant accepts and agrees to these Official Rules and the decisions of Judges, which shall be final in all matters. By accepting prize, winner agrees to hold Promotion Parties, their affiliates, directors, officers, employees and assigns harmless against any and all claims and liability arising out of use or redemption of prize. Promotion Parties are not responsible for lost or late entries, or for technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this contest, or by any human error which may occur in the processing of the entries in this contest. In the event of any such error, Sponsor, with consent of the Regie de alcools, des courses et des jeux, reserves the right to modify, cancel or suspend this contest. In the event a dispute arises as to the identity of a potentially winning online entrant, entries made by internet will be declared made by the name on the online entry form.
6. CHANCES OF WINNING. Chances of winning depend on the number of eligible entries. Sponsor is unaware of how many entrants there may be. The winner(s) may come from any geographic area, so long as they otherwise qualify to enter the contest.
7. PROVINCE OF QUEBEC: Any litigation respecting the conduct or organization of the contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize in the contest may be submitted to the Régie only for the purpose of helping the parties reach a fair settlement.
8. PRIVACY CLAUSE: Kraft respects entrants' right to privacy. Nominator's' names, addresses, telephone numbers, dates of birth and e–mail addresses are gathered for the purpose of administering this contest and conducting publicity about this contest, including publishing a list of winners and winners' entries on this website. By entering the Contest, Nominators (a) consent to Kraft's collection, use and disclosure of their personal information and entries for these purposes and (b) if the nominee is an individual confirm that they have the consent of the nominee to provide the nominee's personal information to Sponsor for the purpose of administering this contest.
